Terms of
Service.

These Terms govern your use of Loonstep. They form a binding agreement between you and Juan Mugica, an individual operator established in Spain ("Loonstep", "we", "us", "our"). By creating an account or using the service you agree to these Terms. If you do not agree, do not use the service.

1. Acceptance

When you create an account, sign in, or otherwise interact with Loonstep, you confirm that you have read these Terms, the Privacy Policy, and any notices surfaced during onboarding, and that you accept them.

2. Eligibility

You must be at least 16 years old to use Loonstep. By signing up you represent that you are 16 or older. If you are not, do not create an account.

Loonstep is a coaching service. Before you start training, before you change your training load, and any time you experience a new symptom, you should obtain clearance from a qualified physician. Loonstep is not appropriate for people with cardiovascular, respiratory, metabolic, musculoskeletal, or other medical conditions, for people who are pregnant, or for people recovering from injury or surgery, in each case absent specific clearance from a qualified professional. By using the service you confirm that you have considered these factors and consider yourself fit to train.

3. Health disclaimer

Loonstep is software, not a doctor, not a physiotherapist, and not a personal trainer. The service does not provide medical advice and does not create a doctor-patient, trainer-client, or similar professional relationship. Outputs are educational. Do not rely on Loonstep to diagnose, treat, prevent, or cure any condition.

Strength training and running carry inherent risks of injury. You assume those risks when you choose to train. We are not responsible for injury, illness, property damage, or other harm arising from your training, including any training carried out in line with a programme generated by the service. Always warm up, use appropriate form, train within your capacity, and stop if something hurts. If you experience pain, dizziness, shortness of breath, chest discomfort, or any other concerning symptom, stop training and seek qualified medical attention.

Loonstep is not a medical device. The service is not intended for diagnosing, treating, or preventing any disease or medical condition.

4. AI-generated content

The conversational coach is powered by a large-language model. Its outputs are generated by software and may be inaccurate, incomplete, or otherwise wrong. The model can hallucinate facts and citations. Treat its responses as a starting point for your own thinking, not as authoritative guidance and not as a substitute for a qualified human coach or physician. You are responsible for the training decisions you make.

5. Your account

  • You create an account using an email address. One account per person.
  • Provide accurate information and keep it current. We rely on your profile to programme appropriately.
  • You are responsible for keeping your sign-in credentials confidential and for all activity under your account.
  • If you suspect unauthorized access, change your password and email privacy@loonstep.com as soon as you can.

6. Acceptable use

When you use Loonstep, you agree not to:

  • Use the service for any illegal purpose, or in violation of applicable law.
  • Attempt to gain unauthorized access to any account, system, or data, including by probing or scanning our infrastructure.
  • Submit content that is unlawful, harassing, abusive, defamatory, or that infringes someone else's rights.
  • Use automated means to create accounts, scrape content, or generate load on the API beyond ordinary human use.
  • Reverse-engineer, decompile, or attempt to derive the source code of the service, except to the extent that applicable law forbids us to restrict you from doing so.
  • Resell, sublicense, or rebrand the service.
  • Use the service to develop a competing product, train a model on the service's outputs, or otherwise extract its underlying methods.
  • Bypass rate limits, abuse-prevention measures, or any access control we put in place.

7. Your content

You retain ownership of the content you put into Loonstep: your training logs, body weight, nutrition data, profile information, free-text notes, chat messages with the coach, and any images you upload. We do not claim ownership of any of it.

To run the service, you grant us a non-exclusive, royalty-free, worldwide licence to host, store, transmit, display, and process your content for the sole purpose of providing the service to you and improving the service's reliability and quality (for example, error investigation and operational analytics). This licence is limited in scope and ends when you delete the relevant content or your account, except where applicable law requires us to retain a copy. We do not use your content for advertising, do not sell it, and do not use your chat conversations to train AI models.

8. Service availability and changes

Loonstep is offered on an "as is" and "as available" basis. We do not guarantee uninterrupted access, error-free operation, or any specific level of uptime. We may add, remove, or change features; pause the service for maintenance; or discontinue parts of the service entirely. We will give reasonable notice before any change that materially diminishes the service for existing users.

9. Intellectual property

The Loonstep software, design, brand, copy, exercise library, and the methodologies behind the coaching engine are owned by us or our licensors. Nothing in these Terms transfers any of those rights to you. Any feedback you send us about the service may be used by us without obligation.

10. Pricing and payment

Loonstep is moving to a paid subscription of €10 per month (launching from Week 3 of the public rollout). Existing beta users will be given notice in advance and grandfathered at no charge. Payment processing is handled by Stripe; we do not store card details on our servers. All payment terms (including refunds and cancellation rights) comply with applicable Spanish and EU consumer-protection law, including, where they apply, the 14-day right of withdrawal under EU Directive 2011/83 and Spain's General Law for the Defence of Consumers and Users.

11. Termination

You can terminate your relationship with Loonstep at any time by deleting your account (see Section 8 of the Privacy Policy).

We may suspend or terminate your access if you breach these Terms, if continued access would expose us or other users to legal or security risk, or if we are required to do so by law. Where reasonable, we will give notice and an opportunity to cure. On termination by either side, the licence in Section 7 ends (subject to any retention required by law) and the provisions that by their nature should survive (for example, Sections 3, 7, 12, 13, and 15) will survive.

12. Disclaimers

To the fullest extent permitted by law, Loonstep is provided without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or that the service will be uninterrupted or error-free. Nothing in this section limits any non-waivable consumer rights you have under applicable law.

13. Limitation of liability

To the fullest extent permitted by law, Loonstep is not liable for any indirect, incidental, consequential, special, or exemplary damages arising out of or related to your use of the service, including injury, loss of data, loss of profits, or loss of goodwill. Where our liability cannot be excluded, it is capped at the greater of (a) the fees you paid for the service in the 12 months before the event giving rise to the claim and (b) one hundred euros (€100). Nothing in this section excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded under applicable law. Consumer protections that apply to you under Spanish and EU law are not affected.

14. Indemnity

You agree to indemnify and hold us harmless from any claim, loss, or expense (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the service, or your violation of any law or third-party right. This obligation does not apply to the extent the claim is caused by our own negligence or wilful misconduct, or where applicable consumer-protection law prevents it.

15. Governing law and jurisdiction

These Terms are governed by the laws of Spain, without regard to its conflict-of-laws rules. The courts of Madrid, Spain have non-exclusive jurisdiction over any dispute arising out of or related to these Terms or the service. If you are a consumer resident in another EU member state, this clause does not deprive you of the protection of mandatory consumer-protection rules of your country of residence, and you may bring proceedings in the courts of your place of domicile as permitted by Regulation (EU) 1215/2012.

The European Commission provides an Online Dispute Resolution platform at ec.europa.eu/consumers/odr . We are not currently obliged or willing to participate in alternative dispute resolution proceedings before a consumer arbitration board.

16. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the current version. For material changes we will notify you by email before they take effect. If you continue to use the service after a change takes effect, you accept the updated Terms. If you do not, you can terminate your account.

17. Miscellaneous

If any part of these Terms is found unenforceable, the rest remains in force. Our failure to enforce a right is not a waiver of that right. You may not assign these Terms; we may assign them in connection with a transfer of the service. These Terms together with the Privacy Policy are the entire agreement between you and us about the service.
